Abstract
This article discusses the use of social media among arbitration actors. Social media have evolved since its inception. In the beginning, social networks were used to stay in touch with friends and family. Now the trend is to follow influencers. The boundaries between personal and professional use have become blurry. Social media are more regulated and supervised now, especially due to privacy and national security concerns. The social media adoption landscape has matured with increasing adoption by all generations. The use of social media can give rise to questions about ethical conduct or even the integrity of the arbitration proceedings. An arbitrator’s old post established evidence of bias; deleting old posts is tampering evidence; failing to use online resources such as social media can constitute professional incompetence or ineffective counsel. Regardless, social media also offers opportunities such as spreading awareness, networking, marketing, and improving the legitimacy of arbitration. The article describes the current state of the guidelines on social media use in arbitration and suggests its best practice.
Bahasa Abstract
Artikel ini membahas penggunaan media sosial di antara para pelaku arbitrase. Media sosial telah berevolusi sejak awal kemunculannya. Pada awalnya, media sosial digunakan untuk tetap berhubungan dengan teman dan keluarga. Sekarang trennya adalah untuk mengikuti influencer. Batas antara penggunaan pribadi dan profesional menjadi kabur. Media sosial lebih diatur dan diawasi sekarang, terutama karena masalah privasi dan keamanan nasional. Tingkat adopsi media sosial telah matang dengan meningkatnya penggunaan oleh semua generasi. Penggunaan media sosial dapat menimbulkan pertanyaan tentang perilaku etis atau bahkan integritas proses arbitrase. Postingan lama arbiter dapat menjadi bukti adanya bias; menghapus postingan lama merupakan tindakan menghilangkan atau merusak barang bukti; kegagalan untuk memanfaatkan internet, termasuk mencari bukti di media sosial, dapat menjadi bukti inkompetensi atau advokasi yang tidak efektif. Terlepas dari itu, media sosial juga menawarkan peluang seperti meningkatkan kesadaran masyarakat dan praktisi mengenai arbitrase, berjejaring antar pelaku arbitrase, dan kanal pemasaran. Hal mana dapat meningkatkan legitimasi arbitrase. Artikel ini menjelaskan kondisi terkini dari pedoman penggunaan media sosial dalam arbitrase dan menyarankan praktik terbaiknya.
