Publication Ethics

In order to maintain the highest quality of publication, Jurnal Hukum & Pembangunan (JHP) requires that all papers are subject to a double-blind peer-review process based on an initial screening by the editor. The following duties are outlined for the publisher, editors, reviewers, and authors, developed by following the COPE (Committee on Publication Ethics) Code of Conduct and Best Practice Guidelines and the Elsevier Guidelines for Publication Ethics and Malpractice Statement. In handling suspected misconduct, JHP is guided by the COPE flowcharts.

The Responsibilities of the Publisher

The Publishing Body of the Faculty of Law, Universitas Indonesia, as the publisher of JHP, is committed to ensuring that editorial decisions are not influenced by commercial considerations and that editorial independence is maintained. The publisher supports editors in handling suspected research and publication misconduct, and ensures that mechanisms for correction, clarification, and retraction are available when needed.

The Responsibilities of Editors

  • Publication Decisions: The editor is responsible for deciding which of the articles submitted to the journal will be published. The validation of the work in question and its importance to researchers and readers must always drive such decisions. The editor may be guided by the policies of the journal’s editorial board and constrained by legal requirements in force regarding libel, copyright infringement, and plagiarism. The editor will evaluate manuscripts without regard to the authors’ race, gender, sexual orientation, religious belief, ethnic origin, citizenship, or political philosophy. The decision will be based on the paper’s importance, originality, and clarity, and the study’s validity and relevance to the journal’s scope. The editor may confer with other editors or reviewers in making this decision.
  • Process Control: The editor must ensure that each manuscript is initially evaluated for originality using appropriate software. After passing this test, the manuscript is forwarded to one or more reviewers for double-blind peer review, each of whom will recommend to accept, reject, or modify the manuscript. The review period is given up to 14 days.
  • Fair Play: The editor evaluates manuscripts for their intellectual content without regard to the race, gender, sexual orientation, religious belief, ethnic origin, citizenship, or political philosophy of the authors.
  • Confidentiality: The editor must ensure that information regarding submitted manuscripts is kept confidential. The editor and editorial staff must not disclose information about a submitted manuscript to anyone other than the corresponding author, reviewers, potential reviewers, other editorial advisers, and the publisher, as appropriate.
  • Disclosure and Conflicts of Interest: Unpublished materials disclosed in a submitted manuscript will not be used by the editor or the editorial board for their own research without the author’s explicit written consent. Privileged information or ideas obtained through peer review must be kept confidential and not used for personal advantage. Editors should recuse themselves (i.e., ask a co-editor, associate editor, or other board member to review) from manuscripts in which they have conflicts of interest resulting from competitive, collaborative, or other relationships with any of the authors, companies, or institutions connected to the papers. Editors should require all contributors to disclose relevant competing interests and publish corrections if competing interests are revealed after publication.
  • Handling Suspected Misconduct: Where research or publication misconduct is suspected—such as plagiarism, data fabrication or falsification, redundant submission/publication, or authorship disputes—the editor will act in accordance with the COPE flowcharts, including giving authors the opportunity to respond and, where warranted, issuing a correction, an expression of concern, or a retraction.

The Responsibilities of Reviewers

  • Contribution to Editorial Decisions: The peer-review process assists the editor and the editorial board in making editorial decisions and, through editorial communication with the author, may assist the author in improving the paper. Peer review is an essential component of formal scholarly communication and lies at the heart of the scientific method.
  • Promptness: Any selected referee who feels unqualified to review the research reported in a manuscript, or who knows that its prompt review will be impossible, should notify the editor and withdraw from the review process so that the manuscript can be sent to another reviewer.
  • Confidentiality: Any manuscript received for review must be treated as a confidential and privileged document. It must not be disclosed to or discussed with others except as authorized by the editor. In line with this journal’s Policy on the Use of Generative AI, reviewers must not upload the manuscript or any part of it to generative AI tools.
  • Standards of Objectivity: Reviews should be conducted objectively. Personal criticism of the author is inappropriate. Reviewers should express their views clearly with supporting arguments.
  • Acknowledgement of Sources: Reviewers must ensure that authors have acknowledged all sources of data used in the research. Reviewers should also notify the editor of any substantial similarity or overlap between the manuscript under consideration and any other published paper of which they have personal knowledge.
  • Disclosure and Conflict of Interest: Unpublished materials disclosed in a submitted manuscript must not be used in a reviewer’s own research without the express written consent of the author. Privileged information or ideas obtained through peer review must be kept confidential and not used for personal advantage. Reviewers should not consider manuscripts in which they have conflicts of interest resulting from competitive, collaborative, or other relationships with any of the authors, companies, or institutions connected to the papers.

The Responsibilities of Authors

  • Manuscript Standards: Manuscripts will follow the submission guidelines of the journal. Underlying data should be represented accurately. A paper should contain sufficient detail and references to permit others to replicate the work. Fraudulent or knowingly inaccurate statements constitute unethical behaviour and are unacceptable.
  • Originality: Authors will submit only entirely original works, and will appropriately cite or quote the work and/or words of others.
  • Multiple, Redundant, or Concurrent Publications: Manuscripts describing essentially the same research should not be published in more than one journal or primary publication. Manuscripts published as copyrighted material elsewhere cannot be submitted, and manuscripts under review by this journal should not be submitted elsewhere. Secondary publication of certain article types (e.g., translations) may occasionally be justified provided certain conditions are met, agreed by the authors and editors of both journals, reflecting the same data and interpretation, and citing the primary reference.
  • Acknowledgement of Sources: Authors should acknowledge all sources of data and cite publications that have been influential in the research. Information obtained privately (conversation, correspondence, or discussion with third parties) must not be used without explicit written permission from the source. Information obtained in the course of confidential services, such as refereeing manuscripts or grant applications, must not be used without explicit written permission.
  • Authorship of the Paper: Authorship should be limited to those who have made a significant contribution to the conception, design, execution, or interpretation of the study. All those who have made significant contributions should be listed as co-authors; others who participated in certain substantive aspects should be acknowledged or listed as contributors. The corresponding author should ensure that all appropriate co-authors—and no uninvolved persons—are included, that all co-authors have approved the final version, and have agreed to its submission and to the inclusion of their names.
  • Disclosure and Conflicts of Interest: All authors should include a statement disclosing any financial or other substantive conflicts of interest that may be construed to influence the results or interpretation of their manuscript. All sources of financial support for the project should be disclosed.
  • Use of Generative AI: Authors must comply with this journal’s Policy on the Use of Generative Artificial Intelligence, including the obligation to disclose any permitted use of AI and the prohibition on using AI to generate the substance of the manuscript, data, or references.
  • Fundamental Errors in Published Works: When an author discovers a significant error or inaccuracy in the submitted manuscript, it is the author’s obligation to promptly notify the editor and cooperate to retract or correct the paper. If the editor learns from a third party that a published work contains a significant error, it is the author’s obligation to promptly retract or correct the paper, or provide evidence to the editor of the correctness of the original paper.
  • Copyright Agreement: Authors should take into account the rights related to the publication and distribution of research.

Plagiarism Detection

Prevention of plagiarism is essential as it provides scientific and academic integrity. Hence, JHP uses the Turnitin plagiarism detection software to screen every manuscript from the initial screening stage. Manuscripts with a high similarity level or containing plagiarism will be returned to the author for revision or rejected, depending on severity, at the editor’s discretion.

Corrections, Expressions of Concern, and Retractions

Where necessary, JHP will publish a correction (corrigendum/erratum) for errors that affect the work, an expression of concern where there are unresolved suspicions, or retract an article in cases of scientific error such as multiple submission, false authorship claims, plagiarism, or fraudulent use of data. These procedures follow COPE guidelines and are consistent with the journal’s Article Retraction Policy.

Appeals and Complaints

Authors who disagree with an editorial decision may appeal by submitting a reasoned response to the editorial office at [email protected]. Complaints regarding the editorial process, ethics, or conduct will be handled fairly and promptly by the Editor-in-Chief in accordance with COPE guidelines.

Open Access

Sharing research results is an important component of the research process; research can only advance by sharing results, and the value of an investment in research is maximized through wide use of its results. Open Access articles are free to all interested readers, and the publisher places no financial or copyright barriers between the readers and the article.

Etika Penerbitan

Untuk menjaga kualitas tertinggi dari penerbitan, Jurnal Hukum & Pembangunan (JHP) mensyaratkan bahwa semua makalah tunduk pada proses penelaahan sejawat ganda-anonim berbasis skrining awal oleh editor. Tanggung jawab berikut ditetapkan untuk penerbit, editor, penulis, dan penelaah, yang dikembangkan dengan mengikuti Kode Etik dan Praktik Terbaik COPE (Committee on Publication Ethics) serta Panduan Etika Publikasi dan Pernyataan Praktik Buruk Elsevier. Dalam menangani dugaan pelanggaran, JHP berpedoman pada bagan alur (flowcharts) COPE.

Tanggung Jawab Penerbit

Badan Penerbit Fakultas Hukum Universitas Indonesia, sebagai penerbit JHP, berkomitmen memastikan bahwa keputusan editorial tidak dipengaruhi oleh pertimbangan komersial, dan bahwa kemandirian editorial dijaga. Penerbit mendukung editor dalam menangani dugaan pelanggaran etika penelitian dan publikasi, serta memastikan tersedianya mekanisme koreksi, klarifikasi, dan penarikan artikel apabila diperlukan.

Tanggung Jawab Editor

  • Keputusan Penerbitan: Editor bertanggung jawab memutuskan artikel mana yang akan diterbitkan oleh jurnal. Validasi karya yang diajukan dan kepentingannya bagi peneliti dan pembaca harus selalu menjadi pertimbangan utama dalam pengambilan keputusan tersebut. Editor dapat dipandu oleh kebijakan dewan redaksi jurnal dan dibatasi oleh persyaratan hukum yang berlaku terkait fitnah, pelanggaran hak cipta, dan plagiarisme. Editor akan menilai naskah tanpa memandang ras, jenis kelamin, orientasi seksual, kepercayaan agama, asal etnis, kewarganegaraan, atau filosofi politik penulis. Keputusan akan didasarkan pada pentingnya makalah, orisinalitas, dan kejelasannya, serta validitas penelitian dan relevansinya dengan cakupan jurnal. Editor dapat berdiskusi dengan editor atau penelaah lain dalam mengambil keputusan ini.
  • Kendali Proses: Editor harus memastikan bahwa setiap naskah dievaluasi awal untuk orisinalitas dengan menggunakan perangkat lunak yang sesuai. Setelah melewati uji ini, naskah diteruskan ke satu atau lebih penelaah untuk penelaahan sejawat ganda-anonim, masing-masing memberikan rekomendasi untuk menerima, menolak, atau memodifikasi naskah. Waktu penelaahan diberikan hingga 14 hari.
  • Fair Play: Editor menilai naskah berdasarkan kontennya tanpa memandang ras, jenis kelamin, orientasi seksual, kepercayaan agama, asal etnis, kewarganegaraan, atau filosofi politik penulis.
  • Kerahasiaan: Editor harus memastikan bahwa informasi tentang naskah yang diajukan oleh penulis tetap bersifat rahasia. Editor dan staf editorial tidak boleh mengungkapkan informasi apa pun tentang naskah yang diajukan kepada siapa pun selain penulis yang bersangkutan, penelaah, penelaah potensial, penasihat editorial lain, dan penerbit, sebagaimana mestinya.
  • Pengungkapan dan Konflik Kepentingan: Materi yang belum diterbitkan yang diungkapkan dalam naskah yang diajukan tidak akan digunakan oleh editor atau anggota dewan redaksi untuk tujuan penelitian mereka sendiri tanpa persetujuan tertulis eksplisit dari penulis. Informasi atau gagasan yang bersifat rahasia yang diperoleh melalui penelaahan sejawat harus dijaga kerahasiaannya dan tidak digunakan untuk keuntungan pribadi. Editor harus menahan diri (yaitu meminta editor bersama, editor pendamping, atau anggota dewan redaksi lain untuk meninjau) dari menilai naskah yang melibatkan konflik kepentingan yang timbul dari hubungan bersaing, kerja sama, atau hubungan lain dengan salah satu penulis, perusahaan, atau lembaga yang terkait dengan naskah tersebut. Editor harus meminta semua kontributor mengungkapkan kepentingan bersaing yang relevan dan menerbitkan koreksi jika kepentingan bersaing terungkap setelah publikasi.
  • Penanganan Dugaan Pelanggaran: Ketika muncul dugaan pelanggaran etika penelitian atau publikasi—seperti plagiarisme, fabrikasi atau falsifikasi data, pengiriman/publikasi ganda, atau sengketa kepenulisan—editor akan menindaklanjutinya sesuai bagan alur COPE, termasuk memberi penulis kesempatan untuk menanggapi, dan bila perlu menerbitkan koreksi, pernyataan keprihatinan (expression of concern), atau penarikan.

Tanggung Jawab Mitra Bestari/Penelaah

  • Kontribusi terhadap Keputusan Editorial: Proses penelaahan sejawat membantu editor dan dewan redaksi dalam membuat keputusan editorial dan, melalui komunikasi editorial dengan penulis, dapat membantu penulis meningkatkan kualitas makalah. Penelaahan sejawat adalah komponen penting dari komunikasi ilmiah formal dan menjadi inti dari metode ilmiah.
  • Kecepatan: Setiap penelaah terpilih yang merasa tidak memenuhi syarat untuk meninjau penelitian dalam sebuah naskah, atau mengetahui bahwa peninjauan cepat tidak mungkin dilakukan, harus memberi tahu editor dan menarik diri dari proses peninjauan sehingga naskah dapat dikirimkan kepada penelaah lain.
  • Kerahasiaan: Setiap naskah yang diterima untuk ditinjau harus diperlakukan sebagai dokumen rahasia dan istimewa. Naskah tidak boleh diungkapkan atau dibahas dengan orang lain kecuali yang diizinkan oleh editor. Sejalan dengan Kebijakan Penggunaan AI Generatif jurnal ini, penelaah tidak boleh mengunggah naskah atau bagian mana pun darinya ke alat AI generatif.
  • Standar Objektivitas: Peninjauan harus dilakukan secara objektif. Kritik pribadi terhadap penulis tidak pantas. Penelaah harus menyatakan pandangan mereka dengan jelas disertai argumen pendukung.
  • Pengakuan Sumber: Penelaah harus memastikan bahwa penulis telah mengakui semua sumber data yang digunakan dalam penelitian. Penelaah juga harus memberi tahu editor tentang setiap kemiripan atau tumpang tindih substansial antara naskah yang sedang dipertimbangkan dan makalah lain yang mereka ketahui.
  • Pengungkapan dan Konflik Kepentingan: Materi yang belum diterbitkan yang diungkapkan dalam naskah tidak boleh digunakan dalam penelitian pribadi penelaah tanpa persetujuan tertulis eksplisit dari penulis. Informasi atau gagasan istimewa yang diperoleh melalui penelaahan sejawat harus dijaga kerahasiaannya dan tidak digunakan untuk keuntungan pribadi. Penelaah tidak boleh meninjau naskah yang di dalamnya mereka memiliki konflik kepentingan yang timbul dari hubungan bersaing, kerja sama, atau hubungan lain dengan salah satu penulis, perusahaan, atau lembaga yang terkait dengan naskah.

Tanggung Jawab Penulis

  • Standar Naskah: Naskah mengikuti pedoman pengiriman jurnal. Data dasar harus disajikan secara akurat. Sebuah makalah harus berisi detail dan rujukan yang cukup untuk memungkinkan orang lain mereplikasi karya tersebut. Pernyataan yang tidak jujur atau sengaja tidak akurat merupakan perilaku tidak etis dan tidak dapat diterima.
  • Orisinalitas: Penulis hanya akan mengirimkan karya yang sepenuhnya orisinal, dan akan mengutip atau merujuk karya dan/atau kata-kata orang lain dengan benar.
  • Publikasi Ganda, Bersamaan, atau Serentak: Naskah yang menggambarkan penelitian yang pada dasarnya sama tidak boleh diterbitkan di lebih dari satu jurnal atau publikasi utama. Naskah yang telah diterbitkan sebagai materi berhak cipta di tempat lain tidak dapat diajukan. Naskah yang sedang ditinjau oleh jurnal ini tidak boleh diajukan ke publikasi lain. Publikasi sekunder untuk jenis artikel tertentu (misalnya terjemahan) kadang dapat dibenarkan sepanjang memenuhi syarat tertentu, disetujui oleh penulis dan editor kedua jurnal, mencerminkan data dan interpretasi yang sama, serta mengutip rujukan utamanya.
  • Pengakuan Sumber Rujukan: Penulis harus mengakui semua sumber data dan mengutip publikasi yang berpengaruh dalam penelitian. Informasi yang diperoleh secara pribadi (percakapan, korespondensi, diskusi dengan pihak ketiga) tidak boleh digunakan tanpa izin tertulis eksplisit dari sumbernya. Informasi yang diperoleh dalam layanan rahasia, seperti penilaian naskah atau aplikasi hibah, tidak boleh digunakan tanpa izin tertulis eksplisit.
  • Kepenulisan: Kepenulisan dibatasi pada mereka yang memberikan kontribusi signifikan pada konsepsi, desain, pelaksanaan, atau interpretasi penelitian. Semua yang berkontribusi signifikan harus dicantumkan sebagai penulis pendamping; pihak lain yang berpartisipasi pada aspek substantif tertentu diakui atau dicantumkan sebagai kontributor. Penulis koresponden memastikan bahwa semua penulis pendamping yang sesuai—dan tidak ada pihak yang tidak terlibat—dimasukkan, bahwa semua telah menyetujui versi final, dan menyetujui pengajuan naskah serta pencantuman nama mereka.
  • Pengungkapan dan Benturan Kepentingan: Semua penulis harus menyertakan pernyataan yang mengungkapkan setiap benturan kepentingan finansial atau substantif lain yang dapat dianggap memengaruhi hasil atau interpretasi naskah. Semua sumber dukungan keuangan untuk proyek harus diungkapkan.
  • Penggunaan AI Generatif: Penulis harus mematuhi Kebijakan Penggunaan Kecerdasan Buatan Generatif jurnal ini, termasuk kewajiban mengungkapkan setiap penggunaan AI yang diperbolehkan dan larangan menggunakan AI untuk menghasilkan substansi naskah, data, atau rujukan.
  • Kesalahan Fundamental dalam Karya yang Telah Terbit: Ketika penulis menemukan kesalahan atau ketidakakuratan signifikan dalam naskahnya, penulis wajib segera memberi tahu editor dan bekerja sama untuk menarik atau memperbaiki naskah. Jika editor mengetahui dari pihak ketiga bahwa karya yang telah terbit mengandung kesalahan signifikan, penulis wajib segera menarik atau memperbaiki karya tersebut, atau memberikan bukti kepada editor tentang kebenaran karya aslinya.
  • Perjanjian Hak Cipta: Penulis harus mempertimbangkan hak-hak terkait publikasi dan distribusi penelitian.

Deteksi Plagiarisme

Pencegahan plagiarisme penting untuk menjaga integritas ilmiah dan akademik. Oleh karena itu, JHP menggunakan perangkat lunak Turnitin untuk memeriksa setiap naskah sejak tahap skrining awal. Naskah dengan tingkat kemiripan yang tinggi atau yang memuat plagiarisme akan dikembalikan kepada penulis untuk diperbaiki atau ditolak, bergantung pada tingkat keparahannya, sesuai pertimbangan editor.

Koreksi, Pernyataan Keprihatinan, dan Penarikan

Apabila diperlukan, JHP akan menerbitkan koreksi (corrigendum/erratum) untuk kesalahan yang memengaruhi karya, pernyataan keprihatinan apabila terdapat dugaan yang belum terselesaikan, atau menarik (retract) artikel dalam hal kesalahan ilmiah seperti pengiriman ganda, klaim kepenulisan yang tidak sah, plagiarisme, atau penggunaan data yang menipu. Prosedur ini mengikuti pedoman COPE dan selaras dengan Kebijakan Penarikan Artikel jurnal.

Banding dan Keluhan

Penulis yang berkeberatan atas keputusan editorial dapat mengajukan banding dengan menyampaikan tanggapan beralasan kepada redaksi melalui [email protected]. Keluhan mengenai proses editorial, etika, atau perilaku akan ditangani secara adil dan tepat waktu oleh Pemimpin Redaksi sesuai pedoman COPE.

Akses Terbuka

Berbagi hasil penelitian adalah komponen penting dari proses penelitian; penelitian hanya dapat berkembang dengan berbagi hasil, dan nilai investasi dalam penelitian hanya dapat dimaksimalkan melalui penggunaan luas hasilnya. Artikel Akses Terbuka gratis bagi semua pembaca, dan penerbit tidak menerapkan hambatan finansial atau hak cipta antara pembaca dan artikel.
