Abstract

The Constitutional Court's decisions regarding election simultaneity demonstrate a highly progressive development in constitutional reasoning. The Constitutional Court has issued at least three decisions related to the election simultaneity model: Decision Number 14/PUU-XI/2013, Decision Number 55/PUU-XVII/2019, and Decision Number 135/PUU-XXII/2024. So far, studies of these decisions have tended to be placed within the framework of constitutional interpretation. However, the Constitutional Court's stance in Decision Number 135/PUU-XXII/2024 goes beyond merely interpreting the constitution to also construct a constitutional provision on election simultaneity by separating national and local elections. Therefore, the focus of this article is the shift in the Constitutional Court's reasoning method from constitutional interpretation to constitutional construction in determining the design of election simultaneity. This study used legal research methods, including a statutory, conceptual, and case approach, to examine three Constitutional Court decisions. The analysis was conducted using the theories of constitutional interpretation and constitutional construction, which distinguish between the discovery of the meaning of constitutional norms through interpretation and the formation of new legal constructions by the Constitutional Court. The results of this study indicate that Constitutional Court Decisions Number 14/PUU-XI/2013 and Number 55/PUU-XVII/2019 remain within the realm of constitutional interpretation. This is because, in these two decisions, the Constitutional Court is still in the realm of finding the meaning of simultaneity based on the norm of Article 22E of the 1945 Constitution. Meanwhile, in Constitutional Court Decision Number 135/PUU-XXII/2024, the Constitutional Court has essentially gone beyond the function of interpretation and entered the realm of constitutional construction. This is because there is no norm of the 1945 Constitution that can be interpreted to give birth to a simultaneity model by separating national and local elections, so that the new legal situation in the decision is entirely the result of the Constitutional Court's constitutional construction. This shift indicates a transformation in the Constitutional Court's function from merely a constitutional interpreter to a constitutional constructor within the architecture of the Indonesian electoral system.

Putusan MK terkait keserentakan pemilu menunjukkan perkembangan penalaran konstitusional yang sangat progresif. Setidaknya, MK telah mengeluarkan tiga putusan terkait model keserentakan pemilu, yaitu Putusan Nomor 14/PUU-XI/2013, Putusan Nomor 55/PUU-XVII/2019, dan Putusan Nomor 135/PUU-XXII/2024. Sejauh ini, kajian terhadap putusan-putusan tersebut cenderung ditempatkan dalam kerangka penafsiran konstitusi (constitutional interpretation).Padahal, pendirian MK dalam Putusan Nomor 135/PUU-XXII/2024 tidak lagi sekadar menafsirkan konstitusi, melainkan telah membangun suatu konstruksi konstitusi terkait keserentakan pemilu dengan memisahkan pemilu nasional dan pemilu lokal. Sehubungan dengan itu, fokus kajian dalam artikel ini adalah bagaimana pergeseran metode penalaran MK dari penafsiran konstitusi menuju konstruksi konstitusi dalam penentuan desain keserentakan pemilu. Kajian ini dilakukan menggunakan metode penelitian hukum dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus tiga putusan MK. Analisis dilakukan menggunakan teori penafsiran konstitusi dan konstruksi konstitusi, di mana teori tersebut difungsikan untuk membedakan antara penemuan makna norma konstitusi melalui proses penafsiran dengan pembentukan konstruksi hukum baru melalui proses konstruksi konstitusi oleh MK. Hasil kajian ini menunjukkan bahwa Putusan MK Nomor 14/PUU-XI/2013 dan Nomor 55/PUU-XVII/2019 masih berada dalam ranah penafsiran konstitusi. Sebab, dalam dua putusan tersebut MK masih berada ranah menemukan makna keserentakan berdasarkan norma Pasal 22E UUD 1945. Ada pun dalam Putusan MK Nomor 135/PUU-XXII/2024, MK pada dasarnya telah melampaui fungsi penafsiran dan masuk pada wilayah konstruksi konstitusi. Sebab, tidak ada norma UUD 1945 yang dapat ditafsirkan untuk melahirkan model keserentakan dengan memisahkan pemilu nasional dan lokal, sehingga keadaan hukum baru dalam putusan tersebut sepenuhnya adalah hasil konstruksi konstitusi MK. Pergeseran ini menunjukkan telah terjadi transformasi fungsi MK dari sekadar constitutional interpreter menjadi constitutional contructor dalam arsitektur sistem pemilu Indonesia.
