Abstract

The paper is purposed to describe / explain criminal laws which regulate domestic violence and the problems happen in Indonesia. This study uses the comparison method which compare substance criminal law of Indonesia with criminal law of Malaysia. The study is focused in the subject matter from criminal law of substantive. The result point out that both of the two countries have had criminal law on domestic violence, Indonesia is regulated at The Act of Elimination of Domestic Violence No 23 of 2004, while Malaysia is appointed at Domestic Violence 1994, and this was amendment on February 20, 2012. This concise comparison can be as a material of criminal law reform

Bahasa Abstract

Makalah ini bertujuan untuk mendeskripsikan/menjelaskan undang-undang pidana yang mengatur kejahatan/kekerasan di wilayah domestic, dan permasalahan yang muncul di Indonesia. Kajian ini menggunakan metode perbandingan yaitu membandingkan substansi hukum pidana Indonesia dengan hukum pidana Malaysia. Focus kajian pada masalah pokok hukum pidana substantive, khususnya perbuatan, sanksi pidana dan permasalahan yang terjadi. Hasilnya menunjukkan bahwa Malaysia dan Indonesia telah memiliki peraturan hukum pidana tentang kekerasan domestic, Indonesia diatur dalam UU No. 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga (UU PKDRT), dan Malaysia diatur dalam Domestic Violence Act 1994 amademen 20 Februari 2012. Perbandingan yang singkat ini dapat dimanfaatkan sebagai bahan pembaharuan hukum pidana.
