Persistent Collaboration: Between International and Indonesian National Law on the Utilization of Earth Orbit

Abstract

This paper examines the legal issues surrounding the utilization of Earth orbit, which is a valuable and finite resource for Indonesia and other countries. Given the international and national space regulations to govern its utilisation are not always consistent, this paper explores the monism-dualism debate in the context of international and municipal law discourse. The method employed in this research is descriptive qualitative. The paper argues that Indonesia can play a significant role in safeguarding Earth orbit for sustainable utilization by embracing the monism principle through persistent collaboration as opposed to both persistent objection and acquiescence. The findings of this research suggest that Indonesian officials and scholars should engage in ongoing discourse on international space law by setting a more comprehensive provision in domestic law first, especially through reconceptualization of Wawasan Nusantara.
