Abstract

The integration of artificial intelligence (AI) in healthcare is progressing rapidly and is applied to various aspects of medical practice, including diagnosis, treatment planning, and patient care. However, the integration of AI in healthcare raises complex legal and ethical issues, particularly regarding medical liability. The growing development of AI technology is blurring the concepts of responsibility and accountability in medical practice. Furthermore, with AI systems becoming increasingly autonomous in their decision-making processes, it becomes increasingly difficult to determine responsibility in cases of medical errors or actions that harm patients. In view of this situation this article argues that it is necessary to re-evaluate the existing legal framework and to formulate new regulations to address the challenges posed by AI in healthcare. Thus, this article explores the challenges of legal liability and proposes a framework related to the medical liability of the integration of AI in healthcare.

Bahasa Abstract

Integrasi kecerdasan buatan, artificial intelligence (AI) dalam layanan kesehatan berkembang cukup pesat dan dapat diterapkan pada berbagai aspek praktik medis, seperti penentuan diagnosis, perencanaan pengobatan, dan perawatan pasien. Meskipun demikian, integrasi AI dalam layanan kesehatan juga menimbulkan permasalahan hukum dan etika yang kompleks, khususnya terkait tanggung jawab medis. Perkembangan teknologi AI yang semakin pesat mengaburkan konsep tanggung jawab dan akuntabilitas dalam praktik medis. Lebih jauh lagi, dengan sistem AI yang semakin otonom dalam proses pengambilan keputusan, maka semakin sulit untuk menentukan tanggung jawab dalam kasus kesalahan medis atau tindakan yang membahayakan pasien. Situasi ini membutuhkan evaluasi ulang dan perlunya pengembangan kerangka hukum untuk mengatasi tantangan yang ditimbulkan oleh AI khususnya dalam layanan kesehatan. Studi ini mengeksplorasi tantangan tanggung jawab hukum dan mengusulkan kerangka hukum terkait tanggung jawab medis dari integrasi AI pada layanan kesehatan.
