Abstract

This study aims to compare the legal approaches to corruption in the construction sector in Indonesia and China. The construction sector in both countries is often fertile ground for corruption, which harms the economy and creates social inequality. This study employs a comparative legal analysis method to examine regulations, policies, and the effectiveness of law enforcement in combating corruption within the construction sector in both countries. The primary focus of this study is a comparison of applicable anti-corruption laws and the roles of law enforcement agencies, such as the Corruption Eradication Commission (KPK) in Indonesia and the Central Commission for Discipline Inspection (CCDI) in China. Additionally, this study examines the challenges encountered in implementing anti-corruption policies in both countries. This study found that although both countries have adopted strong policies to eradicate corruption, there are significant differences in the implementation of law enforcement and procedural transparency. In Indonesia, the main challenges lie in enhancing the independence of law enforcement agencies, overseeing construction projects, and enforcing the law against convicted corrupt individuals. Meanwhile, in China, although the law enforcement system is more centralised, political influence and the need for further reform persist as obstacles. The proposed solution focuses on increasing transparency and integrity in the construction sector for both countries.

Bahasa Abstract

Studi ini bertujuan  membandingkan pendekatan hukum sektor konstruksi di Indonesia dan Tiongkok dalam menangani korupsi. Sektor konstruksi di kedua negara seringkali menjadi lahan subur bagi korupsi, yang merugikan perekonomian dan menciptakan ketidaksetaraan sosial. Studi ini menggunakan metode analisis hukum komparatif untuk meneliti regulasi, kebijakan, dan efektivitas penegakan hukum dalam memerangi korupsi di sektor konstruksi di kedua negara. Fokus utama studi adalah perbandingan undang-undang anti-korupsi yang berlaku, serta peran lembaga penegak hukum seperti Komisi Pemberantasan Korupsi (KPK) di Indonesia dan Komisi Pusat Disiplin (KPU) di Tiongkok. Selain itu juga diteliti tantangan yang dihadapi dalam menerapkan kebijakan anti-korupsi di kedua negara. Studi ini menemukan bahwa meskipun kedua negara telah mengadopsi kebijakan yang kuat untuk memberantas korupsi, terdapat perbedaan signifikan dalam implementasi penegakan hukum dan transparansi prosedural. Di Indonesia, tantangan utama terletak pada peningkatan independensi lembaga penegak hukum, pengawasan proyek konstruksi, dan penegakan hukum terhadap individu yang terbukti melakukan korupsi. Sementara itu di Tiongkok, meskipun sistem penegakan hukum lebih terpusat, isu pengaruh politik dan kebutuhan akan reformasi lebih lanjut tetap menjadi hambatan. Solusi yang diusulkan berfokus pada peningkatan transparansi dan integritas di sektor konstruksi untuk kedua negara.
