Perkembangan teknologi digital di era globalisasi merupakan salah satu tantangan bagi hukum hak cipta untuk tetap bisa memberikan perlindungan bagi Pencipta, yang salah satunya adalah perkembangan dalam musik. Salah satu perkembangan dalam bidang musik yang cukup signifikan adalah hadirnya aransemen-aransemen lagu dalam bentuk remix, dimana terdapat modifikasi dan perubahan atau penambahan dari sebuah lagu untuk menghasilkan lagu yang baru. Dalam kaitannya dengan hak cipta, baik lagu orisinil sebagai sumber remix merupakan objek perlindungan hak cipta serta hasil dari remix tersebut; dapat diberikan penerapan dari pembatasan hak cipta. Dalam hukum hak cipta, terdapat ketentuan berupa pembatasan hak cipta yang bertujuan untuk memberikan keseimbangan antara kepentingan Pencipta serta kepentingan masyarakat sebagai pengguna untuk menggunakan ciptaan dalam kepentingan yang wajar. Hukum hak cipta Amerika Serikat memiliki doktrin terkait pembatasan hak cipta yang dikenal sebagai Fair Use yang diatur dalam U.S. Copyright Act 1976. Sementara di Indonesia, pembatasan hak cipta memiliki beberapa ketentuan sebagaimana diatur dalam Pasal 43 sampai dengan Pasal 51 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Berdasarkan hal tersebut, penelitian ini akan melakukan analisis terkait penerapan pembatasan hak cipta dalam remix lagu yang ditinjau secara komparatif berdasarkan doktrin fair use dan pembatasan hak cipta dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta.
