Bahasa Abstract

Subyek hukum tidak hanya manusia, tetapi juga termasuk badan hukum. Walaupun badan hukum tidak dapat melakukan segala sesuatu yang dapat dilakukan oleh manusia, namun statusnya sama, yaitu sebagai pengemban hak dan kewajiban hukum. Badan hukum adalah entitas imajinatif, yang memiliki identitasnya sendiri tetapi aktualisasi tindakannya diwakili oleh manusia yang, dipandang secara fiktif, diinginkan oleh badan hukum. Seiring dengan semakin canggihnya teknologi robot yang mampu mengambil keputusan secara otonom, muncul pertanyaan apakah robot bisa menjadi badan hukum. Secara teoritis, penerimaan doktrin corporate personhood lebih universal daripada penerimaan doktrin environmental atau animal personhood. Namun sampai saat ini masih belum ada konsensus apakah doktrin corporate personhood tepat untuk diterapkan pada robot. Dalam artikel ini belum disimpulkan apakah robot bisa menjadi badan hukum, namun berbagai perspektif yang digunakan untuk membenarkan robot sebagai badan hukum akan dielaborasi.
