Economic Recession as the Basis for Termination of Employment Due to Force Majeure in Indonesia

Abstract

The economy is the most influential aspect in society. The Economics situation is one of the considerations in fulfilling achievements in agreements. The purpose of this study is to examine the economic recession that can be used as a reason for termination of employment due to force majeure in Law No. 13 of 2003 concerning Manpower. This research is a normative juridical research. The state of the company's economy, which is often affected by the country's economic growth, is often one of the factors why companies have to terminate their employment. The termination of employment under the pretext of an economic recession raises a problem regarding whether the situation of economic uncertainty of a country can be used as a force majeure for employers to terminate employment considering that they must prioritize the sustainability and sustainability of the company. This research found that Law Number 13 of 2003 concerning Manpower needs to be revised, especially regarding economic recession, which can be included as a reason for termination of employment which is clearly standardized

Bahasa Abstract

Ekonomi adalah aspek yang paling berpengaruh dalam masyarakat. Keadaan ekonomi menjadi pertimbangan salah satu pertimbangan dalam memenuhi prestasi dalam perjanjian. Tujuan dari penelitian ini adalah untuk meneliti resesi ekonomi dapat dijadikan alasan pemutusan hubungan kerja akibat force majeure dalam Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan. Penelitian ini merupakan penelitian yuridis normatif. Keadaan perekonomian perusahaan yang kerap terpengaruh oleh pertumbuhan perekonomian negara sering kali menjadi salah satu faktor kenapa perusahaan harus melakukan pemutusan hubungan kerja. Pemutusan hubungan kerja tersebut dengan dalil terjadinya resesi ekonomi menimbulkan suatu permasalahan mengenai apakah situasi ketidakpastian ekonomi suatu negara dapat dijadikan suatu force majeure untuk para pengusaha melakukan pemutusan hubungan kerja mengingat mereka harus memprioritaskan keberlanjutan dan keberlangsungan perusahaan. Penelitian ini menemukan bahwa Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan perlu direvisi terutama tentang resesi ekonomi dapat dimasukkan sebagai alasan pemutusan hubungan kerja yang jelas standarisasinya
