Abstract

Deed of Agreement for Sale and Purchase Agreement Number 01 dated April 24, 2013 drawn up before Notary MS S.H M.Kn. is an agreement made by R as a seller with AT as a buyer with a land object of 3,625 m2 located in Bandung Regency. Before making and signing the Sale and Purchase Deed, which contains the rights and obligations of the parties. among others, regulates the schedule of payments that must be made by the buyer and the schedule for handing over land that must be done by the seller. Where in the implementation, there were defaults that led to the emergence of a lawsuit in the State Court. Thus, there needs to be a definite explanation to be able to prove the existence of an element of default in the Sale and Purchase Agreement based on the decision of the Bale Bandung District Court number 80 / PDT / .G / 2016 / PN.Blb.

Akta Perjanjuan Pengikatan Jual Beli Nomor 01 Tanggal 24 April 2013 yang di buat di hadapan Notaris MS S.H M.Kn. merupakan suatu perjanjian yang di buat oleh R selaku penjual dengan AT sebagai pembeli dengan objek tanah seluas 3.625 m2 yang berada di \ Kabupaten Bandung. Sebelum di buat dan di tanda tanganiya Akta Jual Beli, yang berisi hak dan kewajiban para pihak . antara lain mengatur mengenai jadwal pembayaran yang harus di lakukan oleh pembeli dan jadwal penyerahan tanah yang harus di lakukan oleh penjual. Dimana dalam pelaksanaanya timbul wanprestasi yang menyebabkan munculnya gugatan di Pengadilan Negri. Dengan demikian, perlu adaya penjelasan yang pasti untuk dapat membuktikan adanya unsur wanprestasi di dalam Perjanjian Pengikatan Jual Beli berdasarkan putusan Pengadilan Negri Bale Bandung nomor 80/PDT/.G/2016/PN.Blb.
