Abstract
This paper will assess the progress and challenges of the peace agreement between the Government of Indonesian and Free Aceh Movement (MoU Helsinki) post the enactment of the Law on Aceh Government 11/2006 (LAG), particularly on the vulnerability status of MoU both in national and international legal system. Using normative approach and analysing data from local, national and international sources to describe the recent implementation of MoU. It confirms that after eleven years security and political aspect has been demonstrated, while economic and human rights-related issues remain left behind. Therefore this paper argues that the legalization of MoU in the international procedural system will ensure the compliance of agreement, and strengthen sustainable peace in Aceh-Indonesia context.
Bahasa Abstract
Paper ini ingin menelisik kemajuan dan tantangan dari Perjanjian Damai antara pemerintah Indonesia and Gerakan Aceh Merdeka (MoU Helsinki) setelah disahkannya Undang Undang tentang Pemerintahan Aceh nomor 11 Tahun 2006, terutama tentang persoalan kerawanan status hukum MoU baik dalam hukum nasional dan internasional. Dengan menggunakan pendekatan penelitian normatif isu ini dianalisa berdasarkan sumber data-data lokal, nasional dan internasional untuk mengungkapkan kondisi terkini dari pelaksanaan kesepakatan MoU Helsinki. Akhirnya setelah sebelas tahun MoU, paper ini mengkonfirmasi bahwa kondisi keamanan dan politik di Aceh cukup membaik, namun dalam bidang ekonomi dan hak asasi manusia masih dirasakan ketinggalan. Oleh Karena itu paper ini mengusulkan legalisasi MoU dalam prosedur hukum internasional, supaya terjaminya kepatuhan terhadap perjanjian sekaligus mempertahankan perdamaian yang sudah dirintis antara Indonesia-Aceh.
