Abstract

Abstract

Bilateral Investment Treaty (BIT) or bilateral investment agreement is a reciprocal agreement between 2 (two) countries to increase and protect investment in the territory of each country. Bilateral investment agreements aim to provide protection to foreign investors against discriminatory Host Country actions, and may prevent foreign investors from obtaining rights and interests in their assets. In addition, BIT also has a specific objective, namely to reduce non-economic risks that will open up investment opportunities. One of the clauses that need to be considered in bilateral investment agreements is the clause related to dispute resolution mechanisms.

Abstrak

Bilateral Investment Treaty (BIT) atau perjanjian investasi bilateral adalah perjanjian yang bersifat timbal balik diantara 2 (dua) negara untuk peningkatan dan perlindungan investasi di wilayah masing-masing negara. Perjanjian investasi bilateral bertujuan untuk memberikan perlindungan kepada penanam modal asing terhadap terjadinya tindakan-tindakan Host Country yang diskriminatif, serta dapat menghalangi penanaman modal asing mendapatkan hak dan kepentingan atas aset yang dimiliki. Selain itu, BIT juga memiliki tujuan khusus yaitu untuk mengurangi risiko non-ekonomi yang akan membuka peluang investasi. Salah satu klausul yang perlu diperhatikan dalam perjanjian investasi bilateral adalah klausul terkait mekanisme penyelesaian sengketa.
