Abstract

The purpose of the Antitrust Law which is regulated under Indonesian Law Number 5 of 1999 concerning Prohibition of Monopoly Practices and Unfair Business Competition, is to create market efficiency by preventing monopoly, both productive efficiency and allocative efficiency. Methods that can be used to identify anti-competitive practices are per-se-illegal and rule-of-reason. The era of the digital economy industry has changed the landscape of world economic activity, the presence of Arficial Intelligence, Big Data, and Blockchain, in certain dimensions can help us reach markets more efficiently, but in other dimensions, the presence of this technology makes the elements and characteristics of anti-practice practices competition is becoming more diverse and evolving, which is certainly very different from conventional anti-competitive practices. There are a number of special qualifications, such as Network Effects, Radical Scale Economies, Data-Driven Market, Privacy, and Token Effects that adding specifications to determine market dominance and / or other anti-competitive practices, which in the end forcing law enforcement body in the field of business competition both substantially and structurally need to get preparation, attention to improvement.

Bahasa Abstract

Tujuan dari Hukum Persaingan Usaha yang diatur berdasarkan Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat, adalah untuk menciptakan efisiensi pasar dengan mencegah monopoli, baik itu productive efficiency dan allocative efficiency. Metode yang dapat digunakan untuk mengidentifikasi adanya praktik anti-persaingan adalah dengan per-se-illegal dan rule-of-reason. Era industri ekonomi digital telah merubah lanskap kegiatan ekonomi dunia, hadirnya Arficial Intelligence, BigData, dan Blockchain, dalam dimensi tertentu dapat membantu meraih pasar yang secara lebih efisien, tetapi dalam dimensi yang lain, hadirnya teknologi ini menjadikan unsur-unsur serta karakeristik praktik anti-persaingan menjadi lebih beragam dan berkembang, yang tentunya berbeda jauh dengan praktik anti-persaingan secara konvensinoal. Terdapatnya sejumlah kualifikasi khusus, seperti Network Effects, Radical Scale Economies, Data-Driven Market, Privacy, dan Token Effects menambah spesifikasi variabel penentu dominasi pasar dan / atau praktek anti-persaingan lainnya,, yang akhirnya memaksa para penegak hukum dibidang persaingan usaha baik secara substansial maupun secara struktural perlu mendapatkan persiapan, perhatian sampai dengan perbaikan.
