Abstract

This journal discusses Netflix services in Indonesia within the scope of the General Agreement on Trade in Services. Netflix is a company from the United States that is engaged in leasing movies and television series with a subscribe system that is digitally distributed. Currently the international regime that includes services is the General Agreement on Trade in Services (GATS). GATS regulates services that have crossed the borders of the World Trade Organization (WTO) member based on GATS principles. This thesis uses the study of normative law with prescriptive research and the conceptual approach. The results of this study indicate that Netflix Services are included in the Cross Border Supply mode and are classified in the Audiovisual Services sub-sector Communication sector based on the MTN.GNS/W/120 Classification. the Minister of Communication and Information Circular No. 3 of 2016 concerning Provision of Application Services and/or Internet Content (Over The Top) could affect Netflix services in Indonesia, although it’s policy consistent with Indonesia Schedule of Specific Commitment which is the statement is Unbound. Recomendation for the Ministry of Communication and Information can publish ministerial regulations with contents such as taxation without having to establish which should be in line with GATS provisions.

Bahasa Abstract

Jurnal ini membahas mengenai jasa Netflix di Indonesia dalam lingkup General Agreement on Trade in Services. Netflix merupakan Perusahaan yang berasal dari amerika serikat yang bergerak di bidang penyewaan film dan serial Televisi dengan sistem subscribe yang didistiribusikan secara digital. Saat ini rezim internasional yang mencakup jasa adalah General Agreement on Trade in Services (GATS). Secara garis besar GATS mengatur jasa-jasa yang telah melintasi batas wilayah Negara anggota World Trade Organization (WTO) berdasarkan prinsip-prinsip GATS. Penelitian ini menggunakan kajian hukum normatif dengan tipologi penelitian presktiptif dan pendekatan Konseptual. Hasil penelitian ini menunjukan bahwa Jasa Netflix termasuk dalam mode Cross Border Supply dan diklasifikasi pada sektor Komunikasi sub sektor Audiovisual Services berdasarkan Klasifikasi MTN.GNS/W/120. kehadiran Surat Edaran Menteri Komunikasi dan Informasi No 3 Tahun 2016 tentang Penyediaan Layanan Aplikasi Dan/Atau Konten Melalui Internet (Over The Top) dapat mempengaruhi jasa Netflix di Indonesia, walapun sesuai dengan Indonesia Schedule of Specifix Commitment yang menyatakan Unbound. Rekomendasi dari penelitian ini adalah Kementrian Komunikasi dan Informasi dapat membuat peraturan menteri dengan muatan pasal seperti pengenaan pajak tanpa harus mendirikan BUT yang seyogyanya selaras dengan ketentuan GATS.
